SmartTreeQuote ("we," "our," or "us") reserves the right to modify these Terms at any time. Your continued use of the Services after changes are posted constitutes acceptance of the modified Terms.

SmartTreeQuote provides AI-powered tree service estimating tools and a marketplace connecting homeowners with tree service professionals. Our Services include:

• Instant tree service estimates via web and SMS
• Customer relationship management (CRM) tools for tree professionals
• Lead generation and matching services
• Quote template generation

3. User Accounts

To access certain features, you may need to create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. SMS Terms and Conditions

By opting in to receive SMS messages from SmartTreeQuote, you agree to the following:

• Consent: You expressly consent to receive automated SMS/MMS messages from SmartTreeQuote at the phone number you provided
• Message Frequency: Message frequency varies. You may receive 1-5 messages per conversation
• Message & Data Rates: Standard message and data rates may apply based on your mobile carrier plan
• Opt-Out: You can opt-out at any time by replying STOP to any message
• Help: Reply HELP for assistance or contact support@smarttreequote.com
• Carriers: Carriers are not liable for delayed or undelivered messages

Consent to receive SMS messages is not a condition of purchase. You may use our web services without opting in to SMS.

We may share your phone number with tree service professionals in your area for the purpose of providing quotes you requested. We do not share your phone number with third parties for marketing purposes.

5. Subscription and Payment Terms

Certain features require a paid subscription. By subscribing, you agree to:

• Pay all applicable fees as described at the time of purchase
• Automatic renewal of subscriptions unless cancelled
• Provide valid payment information
• Cancellation policies as described in your subscription plan

Refunds are handled on a case-by-case basis. Contact support for refund requests.

6. Estimates and Accuracy

IMPORTANT: All estimates provided by SmartTreeQuote are for informational purposes only and should not be considered as binding quotes. Estimates are generated using AI analysis and may not account for all factors affecting actual service costs.

• Estimates are approximations based on photo analysis
• Actual costs may vary based on site conditions, accessibility, and other factors
• Final pricing is determined by the tree service professional you hire
• We do not guarantee the accuracy of species identification or measurements

Always obtain a formal quote from a licensed tree service professional before committing to any work.

7. User Content

By submitting photos, text, or other content ("User Content") to our Services, you:

• Grant us a non-exclusive, worldwide license to use, process, and analyze User Content for providing our Services
• Represent that you have the right to submit such content
• Agree not to submit illegal, offensive, or harmful content

We may use anonymized data for improving our AI models and Services.

8. Prohibited Uses

You agree not to:

• Use the Services for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Services
• Scrape, harvest, or collect data without permission
• Impersonate others or provide false information
• Use the Services to send spam or unsolicited messages

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMARTTREEQUOTE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Damages arising from your use of or inability to use the Services
• Any actions or omissions of tree service professionals
• Inaccuracies in AI-generated estimates

Our total liability shall not exceed the amount paid by you for the Services in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Indemnification

You agree to indemnify, defend, and hold harmless SmartTreeQuote and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services, violation of these Terms, or infringement of any rights of another party.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Tennessee.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
